Debt Collection
Unpaid debts are one of the most common legal problems faced by individuals and businesses. Outstanding receivables affect cash flow, damage business relationships, and create financial uncertainty. Attorney Olga Batinica in Subotica handles debt collection proceedings from the initial demand letter through final recovery, with the goal of securing the fastest and most efficient outcome for our clients.
Out-of-Court Debt Collection
Before initiating court proceedings, we always recommend attempting an out-of-court resolution. This approach is faster, less expensive, and preserves business relationships. Our out-of-court collection services include:
- Pre-litigation notice — a formal written demand to the debtor requiring payment within a specified period, with a warning that court proceedings will follow if the debt remains unpaid
- Negotiation with the debtor — working toward an agreement on debt repayment, including the possibility of installment plans or alternative forms of settlement
- Settlement agreements — when the debtor agrees to an out-of-court resolution, we prepare a legally binding agreement
Judicial Debt Collection
When out-of-court collection does not produce the desired results, we initiate judicial debt collection before the competent court — including compulsory enforcement through enforcement proceedings — by filing:
Lawsuit to Establish a Claim Before the Competent Court
Filing a lawsuit before the competent court to establish the claim and obtain a judgment obligating the debtor to settle the obligation. We represent clients throughout the entire litigation process, from filing the claim to final judgment.
Lawsuit with a Motion for a Payment Order
If the lawsuit relates to a matured monetary debt and is supported by appropriate evidence (e.g., invoices, business records, promissory notes, or checks), the court may issue a payment order directing the debtor to settle the debt — provided that a demand for payment was previously sent. This process is significantly faster than regular litigation because the payment order is issued without a hearing.
Enforcement and Compulsory Collection
Enforcement proceedings are compulsory proceedings in which courts and public enforcement officers satisfy creditors’ claims based on enforceable or authentic documents. They are initiated by a motion filed by the enforcement creditor and carried out through various means of enforcement, including:
- Seizure of funds in the debtor’s bank account
- Garnishment of the debtor’s salary or pension
- Sale of the debtor’s movable property
- Sale of the debtor’s real estate
We monitor the enforcement process from the filing of the enforcement motion through complete satisfaction of the claim.
Statute of Limitations
It is important to know that claims are subject to a statute of limitations. The general limitation period is 10 years, but shorter periods apply to certain types of claims — for example, claims arising from contracts for the sale of goods and services expire after 3 years. Timely engagement of an attorney prevents the expiration of your right to collect.
Debt Collection in Bankruptcy
When the debtor is in bankruptcy proceedings, debt collection follows a special regime. We help clients file their claims in a timely manner within the bankruptcy proceedings and represent them at examination hearings for the recognition of filed claims.
